Description: Request for the City Commission to appoint two members to the Tree Board of Appeals.


Fiscal Note: This action does not have a financial impact.

  • Recommendation: The City Commission 1) appoint Marc Frank to serve on the Tree Board of Appeals for a two-year term, ending March 3, 2026 and 2) appoint Larsen McBride to serve on the Tree Board of Appeals for a three-year term, ending March 3, 2027.

Description: Request for the City Commission to approve a Work Order for Pavement Management Construction Services.


Fiscal Note: The work order totals $2,260,400. Funding for this project is available from the Roadway Resurfacing Program Fund. This fund is partially funded with Solid Waste revenues.

  • Recommendation: The City Commission authorize the City Manager or designee to enter into a Work Order Agreement with Watson Construction Company, LLC in the amount of $2,260,400.00 for Pavement Management Construction Services, subject to approval of the City Attorney or designee as to form and legality.

Description: Requesting City Commission approval of a Task Assignment under the Professional Engineering, Architectural and Consulting Services Agreement with CDM Smith, Inc. to conduct an Anaerobic Digestion Feasibility Study.


Fiscal Note: The total cost of the study is $500,000 of which the United States Department of Energy is providing $400,000 via a grant and the $100,000 match is allocated in the Solid Waste Fund.

  • Recommendation: The City Commission authorize the City Manager or designee to enter into a Task Assignment with CDM Smith, Inc. in the amount of $500,000.00 to conduct an Anaerobic Digestion Feasibility Study, subject to approval of the City Attorney or designee as to form and legality.

Description: Request for the City Commission to authorize the Mayor to send a letter supporting the Gainesville Housing Authority’s application to the U.S. Department of Housing and Urban Development for permission to demolish 79 obsolete units in Woodland Park in order to facilitate the construction of 144 new affordable housing units.


Fiscal Note: The City committed $4,285,000 from the American Rescue Plan Act funds to support the development of Woodland Park, Phase 2.

  • Recommendation: The City Commission authorize the Mayor to send a letter supporting the Gainesville Housing Authority’s application to the U.S. Department of Housing and Urban Development to demolish 79 obsolete housing units in Woodland Park in order to allow the development of 144 new affordable units, subject to City Attorney approval as to form and legality.

Description: Request for the City Commission to approve the City entering into a statewide mutual aid agreement in order to receive or deploy mutual aid to other jurisdictions.


Fiscal Note: There is no cost or financial obligation for signing this agreement. Costs may be incurred when an agency requests and receives mutual aid support.

  • Recommendation: The City Commission authorize the City Manager or their designee to execute the 2023 updated Statewide Mutual Aid Agreement with the State of Florida, subject to approval by the City Attorney as to form and legality.

Department: Office of the City Attorney


Description: On November 4, 2021, Ms. Brown was driving her scooter westbound on East University Avenue on her way to work, and was stopped at the intersection with Waldo Road. A Gainesville Police Department patrol vehicle (a Ford Explorer) was stopped at the same light directly in front of her. The Officer driving the Explorer received a call for service, requiring the Officer to head north on Waldo Road. To proceed with the right turn, the Officer reversed to avoid the raised median separating his lane from the turn lane. When he reversed, he made contact with the scooter Ms. Brown was driving. Ms. Brown received medical treatment in connection with this incident, and was diagnosed with a herniated disc in her back. Later she underwent surgical procedures including epidural steroid injections and nerve ablations, which aim to relieve back pain by essentially burning out the nerve on the spine that transmits pain to the brain. Her past medical expenses are approximately $60,000 and estimates of her future medical care claimed by her attorneys are approximately $160,000.


The City’s liability limit is $200,000 per the application of Florida’s limited waiver of sovereign immunity contained in section 768.28, Florida Statutes. Through negotiations with the City Attorney’s Office, Plaintiff has agreed to accept $81,067.27 in full settlement of the claim. Should the matter proceed to trial, a jury would likely be able to consider the fully-billed cost of Ms. Brown’s past medical expenses, along with her claims of future medical care expenses as well as past and future pain and suffering. It is the recommendation of the City Attorney’s Office and the Risk Management Department that the City settle the claim for $81,067.27, and avoid the risk of greater liability at trial.


Fiscal Note: Funds are available in the City’s General Insurance Fund.

  • Recommendation: The City Commission authorize the City Attorney to enter into a settlement agreement to resolve the claim of Kennetha Brown, arising from an incident that occurred on or about November 4, 2021 when Kennetha Brown was involved in a motor vehicle accident with a Gainesville Police Department patrol vehicle.

Description: Stetz Properties, LLC, RJ Karow, and Frank J. Jr. and Cynthia Stetz, represented by CHW Professional Consultants, Inc., are the owners/developer ("Developer") of certain property proposed to be developed into a high-density multi-family development described in application Petition PB-21-0195 SUP. Pursuant to Section 30-3.41 of the City of Gainesville's Land Development Code (Chapter 30 of the City of Gainesville Code of Ordinances), the Developer and all owner(s) of land abutting the subject public right-of-way submitted an application requesting the City to vacate, abandon, and close the subject right-of way for purposes of the development. On May 5, 2022, the City Commission adopted Ordinance No. 210837 and approved the request to vacate the subject public right-of-way, subject to certain conditions. Ordinance No. 210837 included a provision that if all conditions of the ordinance were not finalized with verification recorded in the Public Records of Alachua County, Florida, within two years following the effective date of Ordinance No. 210837 (i.e, May 5, 2024), then Ordinance No. 210837 would be deemed null and void and of no further force and effect. The Developer has made substantial progress towards complying with all requisite conditions and has requested an extension of the deadline imposed by Ordinance No. 210837.

Description: The governing body of a municipality is required to establish a selection committee to select an auditor to conduct its annual financial audit. The selection committee must consist of at least three members, one of whom must be a member of the governing body, who shall serve as the chair of the committee.

  • Recommendation: The City Commission to appoint the Audit Committee to serve as the auditor selection committee to select an external auditor to conduct the City of Gainesville’s annual financial audit.

Department: Wild Spaces & Public Places


Description: Staff presentation on the proposed demolition and rebuild of the City Hall Plaza Ponds to eliminate water features in favor of paved pedestrian areas and Florida-friendly landscaped greenspace.


Fiscal Note: There are capital, operations and maintenance costs associated with the City Hall Plaza Ponds. Staff proposes utilizing in-house resources for the landscaping efforts (Park Operations/Tree Mitigation) and utilize Wild Spaces & Public Places funding for the new concrete work, site furnishings and other supporting trades.

  • Recommendation: The City Commission hear a staff update by Wild Spaces & Public Places, approve the proposed conceptual master plan and authorize staff to proceed with permitting and procurement.

Description: At its March 21, 2024 regular meeting, the City Commission provided direction to the Office of the City Attorney to draft an Ordinance for consideration calling for a Charter amendment ballot referendum. The proposed Charter amendment would delete Article VII of the City Charter entitled “Gainesville Regional Utilities Authority.”


The ordinance is authorized by Florida Statutes section 166.031(1) and Charter 5.01, and adoption of the ordinance requires an affirmative four-fifths vote of the membership of the City Commission. Per Florida Statutes section 101.161(1) and controlling caselaw, the proposed ballot summary must be an explanatory statement that is “clear and unambiguous” and provides voters with the “chief purpose” of the referendum. It should be stated in the form of a question followed by the word “yes” for approval and “no” for rejection. The ballot title shall not exceed 15 words in length. The ballot summary shall not exceed 75 words in length.


If the Ordinance passes by the required four-fifths majority, the proposed Charter amendment shall be placed “to a vote of the electors at the next general election held within the municipality or at a special election called for such purpose.” The next general election is scheduled for Tuesday, November 5, 2024. The State primary election (which also serves as the regular election for City Commission seats) is scheduled for Tuesday, August 20, 2024. To place the ballot referendum on the November 5, 2024 general election ballot, the City must affirmatively notify the Supervisor of Elections no later than June 15, 2024, and provide the actual ballot language in English and Spanish no later than August 1, 2024. If the ordinance provides for a special election concurrent with the State primary election on August 20, 2024, such notice must be provided by May 31, 2024, and language submitted by June 15, 2024.
